Connected Products and Related Digital Services

A connected product within the Everllence portfolio is any physical product that falls within Article 2(5) of the EU Data Act. In practical terms, this includes any physical product that:

  • Obtains, generates, or collects data concerning its performance, use or environment (for example, data concerning its operation, usage, condition or surrounding environment), including through embedded sensors, control systems, electronic components, or associated digital systems;
  • Is able to communicate product data, including by transmitting or providing access to such data, via:
    • an electronic communications service (including wired or wireless connectivity),
    • a physical connection (including service, diagnostic, or fieldbus connections), or
    • on-device access or another  locally accessible data access mechanism;
  • May, as a practical indicator rather than a separate legal criterion, incorporate embedded software, firmware, or electronic systems enabling monitoring, diagnostics, control, optimization, automation, remote services, or other data-driven functionalities.

A product will not qualify as a connected product for these purposes if

  • its primary function is the storing, processing or transmission of data on behalf of a party other than the user, or;
  • The product is provided as a prototype for testing purposes.

Based on Everllence’s assessment, the following Everllence product categories are considered to meet the Article 2(5) criteria:

  • Everllence 2-stroke marine engines (ME engines);
  • Everllence 4-stroke engines produced in Augsburg, with SaCos 1;
  • Everllence engines designed to connect, or capable of connecting, to the Everllence CEON Cloud, enabling digital services, remote monitoring, analytics, or data-driven functionalities, where this supports communication of product data;
  • Everllence turbo machinery products, including but not limited to turbochargers, compressors, turbines, and associated auxiliary equipment designed for CEON Cloud connectivity.

The examples above are indicative guidance only. Actual scope, data availability and access may vary depending on the specific product, bespoke design, configuration, system architecture, customer setup and applicable EU Data Act requirements.

A related service within the Everllence portfolio is, for purposes of Article 2(6) of the EU Data Act, a digital service other than an electronic communications service that:

  • is connected with the functions of a connected product so that, at the time of purchase, rent or lease, its absence would prevent the connected product from performing one or more functions, or is subsequently connected by Everllence or a third party, for example by adding to, updating or adapting those functions; and
  • involves the exchange of data between the connected product and the service provider, for example by transmitting commands, and affects the connected product’s functions, behaviour or operation.

Services that merely receive data, provide auxiliary consulting, analytics or regular repair and maintenance, or supply connectivity or power, are not related services unless they meet the criteria above.

Based on Everllence’s assessment, the following Everllence services are considered to meet the Article 2(6) criteria:

  • Everllence PrimeServ Assist
  • The SaCoS ServicePortal for Everllence 4-stroke engines with SaCoS 5000
  • The Remote Access Unit for Everllence Power Products,
